WHAT IS A 1031 EXCHANGE?

Thanks to IRC 1031, a properly structured exchange allows an investor to sell a property, to reinvest the proceeds in a new property and to defer all capital gain taxes. IRC 1031(a)1) states;

"No gain or loss shall be recognized on the exchange of property held for productive use in a trade or business or for investment, if such property is exchanged solely for property of like-kind which is to be used for the same purpose."

1. Fill out the Property Disclosure Form & make copies for potential buyers.

2. If your home was built before 1978 fill out the Lead Based Paint Disclosure Form , down load & print the EPA's Protect your Family from Lead in your Home Brochure and make copies for potential buyers.

3. Have your buyer fill out the Offer to Purchase Real Estate Form and take a deposit.

4. Fill out the Contract to Buy or Sell Real Estate Form, sign and present to buyer. This is where you will make a counter offer, if desired, to your buyer's first offer.

5. After you and the buyer have agreed on the price and terms written in the contract and both of you have signed it, fill out the FSBO(For Sale By Owner) Title Order Form & fax or mail the form to Ascendant Title. You may also, if desired simple call us or fill out the on line FSBO Title Order Form.

6. Whatever way you choose to contact us we will take it from there. We will contact the buyer's lender and or agent and make all arrangements for escrowing and disbursing all funds along with issuing title insurance and scheduling and conducting the transaction closing at a time and place mutually agreed upon by you and your buyer.
